Met releases 400,000 hi-rez scans for free download, claims copyright over the public domain

It seems to be a matter of splitting hairs. The Met doesn’t really assert copyright for the images what it does is require the user to promise to restrict intended use of the images as a condition of downloading them from the Met’s website. As such I think it is a site access license restriction which happens to include by reference some of the copyright law.
