It’s a hybrid. It’s pure prior appropriation prior to 1913, and a weird combination after that. But maybe I missed something in the story. If there’s a creek on the land, the question of who has rights to any water is a separate issue.

In all events, I like the creation of the Life estate for the fellow selling the land. A nice way to give the tribe immediate access while still letting him enjoy the property he grew up on.

It’s a comment on the Laws that exempt Native American groups from Tax and Zoning laws. In areas where these is a high tourist trade…you bet they’ll have a casino and a hard rock cafe and take advantage of it.

The racial stereotype here is that Native Americans are all Earth worshipers that do quaint dancing for tourists, when in fact they’re just the same as every other human. And if they can profit a few million for each tribal member taking advantage of the law, what you do think the outcome will be?
That is about HUMAN nature not racial stereotype.

Just… Don’t. They have names, they are not ‘just HUMAN’, and if you are concerned about casinos and cigarettes you can visit their Facebook page and actually talk to them.

Or just read their updates where they talk about nothing of the sort.

True. Native Americans can’t be lumped into one identity. There are so many cultures, it makes the few pockets of different Americana seem very homogenous.
