None of can decide that. It already either happened or not. Each of us individuals can decide whether or not we believe the person did the thing, using whatever criteria we see fit.
To say that we must defer our judgement to the courts is to say that it was right that Dred Scott was not freed because that’s the way the court ruled or that the internment by the U.S. government of citizens of Japanese descent was a-okay because a court said so.
