Came here to observe exactly that. He entered into a contract as a free individual, and failed to observe his obligations. According to Libertarianism 101, the correct response would be for the community to form a posse and him to be at least tarred and feathered.

Indeed. “Liberty” as expressed by this country’s ideologues is undermined by the fact that we don’t all live in rural regions with miles separating each homestead. They are big proponents of doing whatever they want, but not so good with allowing others to do the same if it affects them or offends their sensibilities (i.e. moral hazards). There’s no room in their egoist viewpoint for the rules that govern interactions that are more complex than “I shot first. He’s dead. I must be in the right.”

I suppose you can read this as a variation on “letting the market decide.”

His neighbors are “the market” and they decided they didn’t want to deal with his damn leaves and branches anymore.

The appeal of the HOA might not be that they dictate his behavior, but the behavior of the riffraff peasants who live in the smaller houses.

I argue that the fundamental purpose of the state is to force internalisation of externalities. Libertarianism is much more palatable once that’s accepted. Particularly when you realise poverty is an externally.

Mostly the same here. my agent gave me access to her search system, and an HOA was the Kiss of Death on any listing I saw, regardless of how sweet a deal it was or how well the house was a fit otherwise.

I’ll never understand folks who want a 4 bedroom, 2.5 bath with an attached garage and and entire new layer of government; I told my agent both times I bought a house that if she ever so much as showed me a house with an HOA, we were done.

Yeah I hate the idea of HOAs because they’re just passing the buck of city/county government to an organization which is largely not beholden to the people who pay its fees. I’ve read tons of stories where some HOAs are basically slush funds for those who run it (buying all kinds of stuff like groceries and the like while neglecting road maintenance).

The thing that gets me, is that it’s not like he doesn’t have other options for living in Kentucky. I’d guess that the vast majority of middle and upper class housing isn’t in areas with an HOA and that he and his family could easily find a location, close to where they want to be (near the capital, I’d guess, since he probably has an office there), with some space. He could easily have his libertarian homestead, with little interference, I’m sure.

EXACTLY. There are places and price points where non-HOA options are very limited. RP is wealthy enough, and I’d bet the Kentucky is sufficiently anti-regulation enough that he has plenty of other options.
