They’re not asking to profit from the lawsuit; they’re simply asking that, if they’re right that their use was fair use, they not be required to pay for the privilege of establishing that they are within their rights to use the song. If the Beasties immediately settled, they almost certainly wouldn’t have had to pay any of these costs, because GB was not asking for any money.
