I agree, although where it breaks down is that (according to the article) the statutory minimum penalty would be around $3million, while the MPAA is asking for around $600million. The article makes it sound like they’re not trying to bring it below the statutory minimum, but are trying to prevent the maximum.
I’m not a lawyer, but I would think that if what is being asked for is that much higher than the minimum, the defendant ought to be able to present evidence showing that what they were doing wouldn’t justify the punishment.
