Well, all the assault degrees are really about intent and extent. So in this case it was more “crime of passion” than premeditated, and it was only one swing, not multiple blows.
And generally prosecutors go for the lowest crime that they know they can get a conviction on. Like you’d hate for this lady to walk on a technicality because you couldn’t get a jury in Minnesota to agree the mug was “a weapon.”
