There is a third option, one that I think is most likely with the current court: The Court issues a narrow opinion that applies only to the cases at hand, keeping us with the status quo.
Also, I will remind people not to try to decide how the case is going to go based on how the arguments go. The justices are often most hostile to the side they are leaning towards.
