These are all reasonable points and a defence along those lines might well succeed although I think it bears more resemblance to how IP laws should be than how they are.

SCP Vs copyright lawyers sounds like a good idea for an SCP, if it’s not one already (copyright lawyers are absolutely dumb enough to have a pop at a shadowy transnational security organisation with Lovecraftian powers, because of course).
