That’s what makes Phosphorus such a tricky customer: It’s a superb smoke agent, an excellent incendiary/tracer composition, and a moderately nasty toxin (not in the same class as purpose-made nerve agents or anything; but definitely enough to qualify).
Since it has lots of legitimate uses, it’s totally unproblematic to hand out Phosphorus-based munitions of various sorts without taking any diplomatic flack; but having a little “This device is for smoke generation only, definitely don’t use it to cause the guys who’ve holed up in that building over there and are causing you lots of trouble to run screaming into the open where you can kill them or burn alive in their holes. That would be naughty.” label isn’t a terribly strong safeguard.
