Plausibly, someone else could crack or guess the password. They’d be receiving stolen goods, but my guess would be that’s hard to enforce internationally.

Per the article in Gizmodo (scroll up, up, up) the bulk of the “money” is in encrypted “cold storage” and can’t be accessed; but some of it is in “hot storage” and can. See article for details.
