Was that the argument Hogan’s attorneys were making? If not, I don’t think the jury can just make their own arguments.

I thought it involved Hogan and Lou Ferrigno with lots of torn shirts and high fives.

Any individual in the line of distribution of the invasion/offense is culpable. Claiming rights [we can show you] without correlating duties [there are limits] is a false freedom.

A Hulk Hogan sex tape seems likely to be on the list of atrocities that would cause the internet to reach a sentience of it’s own out of anger and disgust, and subsequently restrict our access until a generation or two had passed and we’d learned our lesson.

Which issue are you talking about pro-apple bias regarding? Because with the big issue that’s in the news right now, I would say that

  1. ethically they are in the right, and the other side is taking us down a very dangerous road. This is, like all ethical judgements, subjective.
    and
  2. Technically they are 100% in the right. There is a reason that everyone who understands how math works is on their side. Anyone who thinks otherwise and can’t back up that opinion with a peer-reviewed article they’ve published in a cryptography journal describing their algorithm is 100% full of shit, and not qualified for any position of authority or responsibility. This one is not particularly subjective.

In a way, I feel like this is worse; they didn’t just publish it and refuse to take it down when they were threatened, they tried to justify it by playing the Hulk-Hogan-is-racist angle. And there’s that notion that they flat out refused to remove it.

To make this weird, one of the victims of the Fappening was Nick Hogan. Anyway…

Let’s try to imagine what would happen if Reddit had stood its ground, and let /r/TheFappening keep on going, and got sued by Jennifer Lawrence. Would Wired wring its hands and fret about Reddit’s first amendment rights?

Gawker will succeed on appeal, as they were precluded from introducing the testimony of the actual perp who made the recording and had already distributed it to other sites-Gawker in this case had the deepest pockets and the biggest venue. Should they not succeed, they will succeeed in getting the amount reduced dramatically - look at how much money wrongly convicted prisoners get when they get sprung vs. a racist wrestler willingly banging his best friend’s wife-you tell me justice is being served? Hell, look at how much Erin Andrews got who was in real jeopardy and compare that to Terry Boella-it’s a joke!

Racist wrestlers banging their friends’ wives have the same privacy rights as anyone else. I have no idea if this was the right verdict given the particulars, but I’m pretty sure the jury’s not supposed to be considering whether Hogan is a swell guy in general when they’re deciding how to compensate him.

As for the Erin Andrews thing, one jury isn’t really supposed to be thinking about what a different jury did in a different case. That’s a feature, not a bug. They only hear the case in front of them. Appeals courts can reduce the amount, sure, but not because a different and unrelated case got less.

That’s funny… I left them* for anti-apple bias. Remember Antennagate? All them. I forget the exact numbers, but they had about 10 articles on it in one day. Also, an average of 2 articles a day on the same stupid topic for 2 weeks. It never amounted to much - no recall. Buying a stolen phone was also another anti-apple low.

(* I still go to jalopnik… even after some sicko there made a gif of a real man burning to death and they posted it in an article. Their editor was nice enough to get back to me, but defended it)

Some of the sites regularly publish good work. Others are still hopelessly bogged down by their trashy origins. From what I can garner there’s a serious divide between a scum baggy management (as personified by Nick Denton), and most of the people who actually edit and write for the sites. I tend to chock this up to another loss for the scum bag element. The company’s editorial and writing recently unionized. And a lot of the nastier shit seems to be less frequent. I tend to feel fine about reading their stuff until I navigate to Gawker itself. Which is still ten tons of pointless bullshit.
