Brings to mind anti SLAPP legislation (“Strategic lawsuits against public participation”)

I wonder if states could make laws effectively similar to CDA 230 just like some states have anti SLAPP provisions?

I agree strongly with @orenwolf’s concern how this could effect the bbs. Or smaller Reddit communities.

(I may be in the minority who actually enjoy Reddit, when curated with a focus on smaller subreddits)

Analysis Following a fit of indignation at Twitter’s decision to apply a fact check notice to some of his recent Twitter messages, US President Donald Trump on Thursday signed an executive order that purports to limit the liability protection afforded to internet platforms when they take action on user posts.

But the nonsensical order doesn’t really do much at all. As Eric Goldman, law professor at Santa Clara University, put it in a phone interview with The Register , “It’s political theater.”

Following up, a reminder that Biden is also gunning for Section 230. So this foundational rule is under threat from two out-of-touch Presidential candidates who probably still see the Internet as “a series of tubes”.

It won’t be the reddit’s of the world who are affected existentially. It will be the mastodon’s of the world that are. Make no mistake, any regulation of online speech will, very quickly, cause a massive increase in the total percentage of online speech contained in a few large applications. They’re the only ones who will be able to afford both the technological measures mandated (or implied by legislation) and legal fees.

Take away the speech part. This is the #1 reason why there is no “youtube mastodon”. It would be sued out of existence immediately.

Personally I think this’ll not survive a legal challenge. Twitter seems more than willing to get this to the point that they have actionable standing.

I mean, they could just ban the guy.

With the way Trump and McConnell have packed the bench, I’m not too sure. We may be past the tipping point into having President-for-Life Trump be the absolute ruler.

I suppose I should get used to saying that I, for one, welcome our new orange overlord.

Remember, if it can be used for them, it can be used against them.

Even with their bench packing, when the balance shifts, and it will shift, do you think judges would let it stand long when the FTC starts levying multi billion dollar fines towards breitbart, infowars, foxnews (they censor comments, so… they’re under this rule too) and other such sites?
