A simpler solution would be to just permit class action civil suits and to pass a law permitting the use of statistical evidence of discrimination. This would incentivize lawyers to find discriminatory practices.
It would cause major problems with the jury system in the US. Much as I like the idea of lawyers trying to explain chi-squared or Mann-Whitney U to jurors, many of them would need to go back to school for years just to understand the explanation.
