That is some amateur lawyering.
Simply declare the harassment as an official act by the president and then is case closed. Covered by official immunity.
They could even put it on C-SPAN after hours.

I remember watching Penn and Teller’s Bullshit and they explained that in addition to the obvious attention-grabbing properties of the name of the show, it served a second function. If they called someone a liar, they could potentially be sued. But if they said something was bullshit and called the person who said it a motherfucker, they couldn’t because those wouldn’t be taken as factual claims.
I was reminded of this when I read, “Trump… responded by calling her a liar.” Should have just said it was “bullshit”.
