Maybe they need to be more easily removed. Would that help? Of course, then you have the problem of “By whom?”

The defendant had already been convicted, and the judge had already determined the sentence, and was merely reading his decision aloud. In theory, there was nothing that the defense could present to change the judge’s mind.

That said, I agree that at no time should a defendant be without representation in the legal system, even when there’s “nothing they could do.”
