I really don’t understand corporations thinking in cases like this. A class action lawsuit is inevitable. If the suit goes to trial, their loss is inevitable. Will they settle before that point? Almost certainly. Will it take years? Yes. But that’s years of costly litigation that Norfolk-Southern will have to pay. Delaying the inevitable will cost them more than it will the property owners. I do not understand the calculus that leads them to any decision other than cutting everyone a check as soon as is practical. In the end, the only people who will actually profit from this are the attorneys.
