Spain leads the way: rape is about consent, full stop

A series of court cases prompted outrage when men were convicted of sexual abuse, rather than the more serious offence of sexual assault.

The new law will abolish that distinction so that rape will instead be decided by the question of consent.

Rape defined not by what method the rapist used – no more using ‘it was only X’ as a defense – but simply by whether or not there was consent. Clear and fair.
