Copying may not be theft, but it is a kind of trespass. The rightholders of those fenced lands would really rather not get into the finer points of how it is they get to enforce those rules.

P.S. I recommend that everyone bothered by Teespring’s evasive, indifferent, and insensible response send an email (to legal@teespring.com and support@teespring.com) letting them know how you feel, and perhaps indicating that you plan to shop elsewhere from now on.

This was one of the points made on TechDirt, Copying is not Copyright Infringement. The Lenz v. Universal ruling stated that fair use is a non-infringing use. (At least in the 9th Circuit)

To use your trespass example fair use is like an easement. It may be someone else’s land, but you can enter it without it being a trespass for the reasons allowed by the easement.
