There are situations where you have a series in which half of the books that featured particular characters are public domain, and there are people doing derivative works with those characters, they just have to be careful to not use elements from the books of the series still under copyright.
The Fleischer cartoons are complicated by the fact that it’s derivative work based on something that’s still under copyright and there are active trademarks involved.
