The best justice in this case would be of a more direct kind: Let the courts dismiss any charges against parents and legal guardians while they (justifiably) take this fine gentleman where the kids can’t see something unedifying and give him… proof of why one shouldn’t ever behave in this manner. Alternatively, they can film the whole incident and put it on YouTube together with name and other identifying information.

Is there no equivalent to the charge of “Incitement to ethnic or racial hatred” in South Dakota? That would also seem appropriate if available.

There’d be no charge. The cop would be cleared of any wrongdoing in the unfortunate death of the suspect (at least, if I’m correct in the assumption that they don’t bother to file charges after a person is dead)
