Scalia proudly leading the 2005 opinion, of course. Colorado had specifically “in response to increased attention to the problem of domestic violence during the 1990’s, made arrest mandatory for violating protective orders.” But oh no, Scalia insists those mandatory arrests weren’t required because “a well-established tradition of police discretion has long coexisted with apparently mandatory arrest statutes.” So the three young children were murdered. Small price to pay to protect the man’s freedom of movement, right? And this ruling now protects the police from liability, anywhere in the country, ever.
This is why we can’t have nice things.
Scary, how the APD said the murderous officer wouldn’t have a badge or gun due to past misconduct, but yet how he was the shooter who killed a man…
