Oh, absolutely. When people were suggesting that it wasn’t clear what he had done, I respectfully pointed out that that wasn’t the way that I had read his post, and would have been horrified if he had clarified that I was wrong.
I only got snippy in that reply because @wrecksdart had already explained that that interpretation of his post was incorrect, but @aluchko couldn’t be bothered to read that far before replying.

Now that you’ve asked, and so politely, I make this internet promise to never, ever drive in an illegal manner again. I want to escape the Ballpark of My Wrongness and leave it by train to ultimately enter the Ballpark of Rightness, if the train travels that far and tickets are available. Also, if I have to drive to the Ballpark of Rightness, I will do so in a lawful manner, unless and until there are no available parking spots or they are too expensive, in which I will return to the Ballpark of My Wrongness if I can remember the way.
Using your brakes doesn’t cause a crash unless the person behind you is following too close. Even if you want to claim 2 wrongs don’t make a right, the brake checker arguable had a right of self-defense, which the tailgater didn’t. Brakechecking is a bad, fine. But without tailgating it wouldn’t be an issue.
Did you actually watch the video I have posted? It is difficult to maintain a safe distance when an idiot intentionally swerves in front of you and slams the brakes. You were asking about situations where the rear-ender would not be held responsible - and that is exactly the situation where the guy in front would be at fault. The code here actually forbids abrupt braking and direction changes without reason, it is just hard to enforce unless there is a video or a witness.
If you are talking about the video in the article, yeah, that was an instant karma and they got what they deserved.
I feel like some people ITT need to keep a stack of bricks in the passenger seat, you know for “protection” as a “warning” message to all those tailgaters…

Agreed. Wanting a safe distance is not the same as being an asshole and not wanting to let people in.
And I stand corrected, I was indeed referring to the video in the article.
Tailgating is reckless driving, because if the front car has to hit their brakes for any reason that is not obvious to the car in back, then the back car won’t have enough distance or time to stop without causing a collision. I still say we don’t have enough information from this video to determine if the front car had a legit reason to hit the brakes. They might have thought there was something in the road. They might have really seen something in the road that isn’t visible in the video. They might have had a medical problem suddenly while driving, or a bee flew in the driver’s eye. Given that you can never know when a vehicle in front of you might have a reason to stop quickly, you’re driving recklessly if you don’t give yourself enough room to stop.
Why did the tailgater let off the brakes? That appears to have significantly contributed to his losing control.
I suspect drugs.
