I doubt the NDA trumps whatever local transparency laws may be in force, if it’s even legal to begin with. Police departments aren’t the Pentagon, they generally can’t have black holes labeled “TOP SEEKRIT” in their budgets.

Im pretty sure my local mall has one of these and is applying it actively in marketing. A yogurt franchise i opted in with only sends me coupons when i am in that mall. But it’s probably a coincidence.

It doesn’t have to masquerade as a cellphone network. If you have a smartphone, it’s constantly broadcasting enough information about it’s wifi and/or bluetooth to fingerprint your device anyway: http://www.libelium.com/products/meshlium/smartphone-detection/

To be fair I’d be disappointed in any municipal authority that wasn’t disguising its spying devices. Aren’t we all fed up with half-assed metropolitan surveillance? These are our tax dollars at work!
