By the way, is this was the most polite cease-and-desist letter you’ve ever seen? The lawyer even writes,

We encourage you to be creative in designing and using your own
logos or trademarks to clearly identify you as the source of the efforts. Hopefully you see this as an
opportunity to creatively and distinctively come up with something new and clever on your own.

To be fair, there are plenty of people who don’t know the basics of AMERICAN, much less world history - although I doubt they aren’t being taught that Stalin and Mao are mass murders, more like the whole thing is glossed over. The field at HS level is invariable taught by coaches, not historians. It’s not a huge surprise that people don’t understand the basics.

Well, people are being arrested in record number in DC over a specific issue relevant to a specific candidate’s platform, and all we can seem to talk about is his “tone” and trademark bullshit. Some days I wonder if Americans could follow a bouncing ball in a sing-along video, much less the more salient bits of history and politics.

Only if it’s clearly a parody. Sanders has identified himself as a socialist so some people might think his campaign really put out a shirt like that or it came from legitimate supporters who the campaign is deliberately ignoring.

Being somewhat plausible is a standard element of parody.

It’s really hard to see how the Sanders campaign can recover from these scandals. I mean, between this and revelations that he is part of the wealthy elite top 5% of income earners in the US (or 5 percenters as they are known) his campaign must be in complete disarray.

IKR, when I heard that his partner does their taxes, just like my own, I was shocked. Shocked I tell you. And he wants to lead?

A failed plutocrat is what kind. This guy was in a position, has been in a position for decades, to totally monetize his work in elected office, but did he? Nooooo. WTF?

Sure, but if you’re using the target’s trademark then I think you need to make sure it doesn’t cause confusion.

Except that’s NOT the point Sander’s people are making. They’re calling it a trademark infringement. Their complaint has nothing to do with who Sanders is pictured with.

Except… the logos are not really alike, and the “official” logo is missing a TM indicator, so it’s probably not trademarked. So they made up a bullshit story to try and stop something they don’t like.

Um, hello? the T-shirt uses Bernie’s likeness without permission for financial gain. It doesn’t matter if “©”, “®”, or “™” appears on the original T-shirt or not.

In exactly the same way, except for general shots of public places/events, any video or film being recorded must get permission from any portrayed individual(s) before using their likeness(es). And you’re not going to use any other famous peoples’ likenesses without permission, either; wanna try that with LeBron James? Michael Jordan? A-Rod? Geroge Clooney? Donald Trump? Hillary Clinton? You sure you wanna go there…?

You own the trademark of your own likeness, that simple.
