I would disagree with the premise of the post. If you must be an asshat and intentionally derail a train you absolutely should do it in Nebraska rather than, say, Germany:

This translates to a mandatory minimum jail sentence of 1-10 years for intentionally derailing a train, in addition to any other charges.

Knew a guy who worked on the CNN. Accidentally derailed a locomotive when he was working on by himself near Golden, BC. He took a while to think about it, not really wanting to report it, then figured out how to get the locomotive back on the rails by himself.
Do NOT try this at home, kids. Or even out workin’ on the railroad.
