In my head, it’s kind of like going into a poker game and somehow convincing the casino that you have more money then you actually do. If you win, is it a crime? He’s looking at the fact he’s gotten away with it for decades as proof it’s not a crime.

In a criminal trial, yes. But this is a civil trial, and the decision makers (in this case the judge, no jury) is allowed to draw an Adverse Inference based upon a known lack of any proffered exculpatory evidence.
