This seems like a real-life Prisoner’s Dilemma: you’re arrested, and you know others have been or will also be arrested, and the ability to walk away without significant prison times goes to the first prisoner to break ranks and implicate the hgher-ups.

Umm, yeah, the whole point is whether those fringe benefits are reported as income and taxed or provided as a workaround to avoid paying tax on income…

I’m also curious at what point they stop being “fringe” benefits. The current case has the fringe being a pretty large share of overall compensation.

I saw a legal analyst saying the suit pretty much alleges that social media companies work in concert with the federal government and so the first amendment applies.

If you think reality is a Rorschach test then I can almost see the argument. Though even in that kaleidoscope world I think the argument might be significantly undercut by Trump being the head of the executive branch at the time the bans were imposed.

It’s that age old question: Can the president make a first amendment right violation that even he cannot be protected from?
