If he should be punished for anything it should be the torture he participated in, not his cooperation in an investigation to uncover it.

Exactly—he should be punished for being a shitbag and/or torturer, not for helping to expose that torture. We should incentivize the behavior we want to see and discourage the behavior we don’t.

If torture carries no punishment but ratting out your fellow agents does then why should we expect any other CIA interrogators to stop torturing people?
