Implement a new policy, crack down hard, and when the courts tell you itâs unconstitutional, shut it down and implement a new new policy. The Canadian government did this with our prostitution laws. when they were struck down by the courts they just brought in new laws that were basically the same as the old ones, knowing it would take years and years before someone got together the evidence and the resources to get the new law struck down.
Courts donât actually have an enforcement arm, so they only have power insofar as they have the respect of the government.
20 So they watched him and sent spies who pretended to be honest, in order to trap him by what he said, so as to hand him over to the jurisdiction and authority of the governor. 21 So they asked him, âTeacher, we know that you are right in what you say and teach, and you show deference to no one, but teach the way of God in accordance with truth. 22 Is it lawful for us to pay taxes to the emperor, or not?â 23 But he perceived their craftiness and said to them, 24 âShow me a denarius. Whose head and whose title does it bear?â They said, âThe emperorâs.â 25 He said to them, âThen give to the emperor the things that are the emperorâs, and to God the things that are Godâs.â 26 And they were not able in the presence of the people to trap him by what he said; and being amazed by his answer, they became silent.
If I had heard that anecdote a few years ago it may have been insightful. At this point I think most of us can imagine exactly how that scenario would happen before being told about it.
