He was maliciously and with malice aforethought trying to trick us into thinking he was an unarmed noncombatant, which was a ruse to lure us into a trap, which forced us to shoot him in self defence. When, after investigation, we discovered that he was in fact unarmed, that just means he was trying to force us to shoot him in order to make us look bad, which meant he was actively taking part in military operations, which makes him a combatant, which means we were justified in shooting him QED.
