And that those fucking monsters Trump and “it’s February 2016, and it’s an election year, and we can’t possibly confirm a new Justice to replace Scalia” McConnell forced through her replacement as quickly as possible mere weeks before the presidential 2020 presidential election because who cares about double standards.

I also find it curious that people on the right are furious about Biden’s commitment to put forth a Black woman nominee. I mean shouldn’t they at least wait to see who he puts forward and what her jurisprudence is like? For all these complaints about “identity politics” and “racial politics” they sure seem to be angry despite no names even being put forward. :thinking:

(Never mind Reagan’s commitment to put a woman on the bench, or Bush replacing Marshall with Thomas as if all Black people are interchangeable, or RBG getting replaced with another woman.)

Also, maybe she was one of those old-school idealists who actually believed that Federal judges should not make decisions on partisan political concerns and saw her sole duty as “making rulings as she saw fit for as long as she was willing and able to do so.”

It wasn’t RBG’s responsibility to make sure a woefully unfit President would not be the one to appoint her replacement. That was the responsibility of the American people, and the American people fumbled that one quite badly.

But that’s why it’s entirely fair to criticize both her and Justice Breyer if that was their reasoning. The practical effects were obvious when Justice Thomas replaced Justice Marshall. Justice O’Connor famously said her retirement plans were ruined on election night in 2000 when the networks first called it for Gore decades ago.

Justice Breyers resignation should cover any possible holdups that Republicans could have introduced:

I intend this decision to take effect when
the Court rises for the summer recess this year (typically late June or early July) assuming that by then my successor has been nominated and confirmed.

yeah, im assuming the terrible thinking is: if the seat isn’t filled right away it becomes a motivation - really a threat - to drive people to vote :confused:

she’s more than qualified. especially compared to bunker boy’s picks. but we’ve put her through the wringer enough

i wouldn’t put my worst enemy through the meat grinder of media coverage and confirmation she’d have to endure

speaking of: it’s great they want to pick a black woman, but that seems to me like it comes with a responsibility to recognize how much harder the process will be for her. they can’t just say “good luck” and throw her under the bus as a sacrifice to diversity

secret service protection from the moment of nomination comes to mind as a bare minimum
