Nope! Getting dosed with a psychoactive you’re not expecting is a poisoning, and gets prosecuted as such.

Fair enough, but you might want to factor in that in the class of “psychoactives” is included ethanol. And just think how many fine culinary recipes were ‘not expecting’ as including three glugs of brandy. That is, there’s a soupcon of old negative legal views on marijuana in that 10 year sentencing here.

Not sure that’s an apt comparison, I don’t think “people getting drunk from desserts they didn’t realize contained alcohol” is really a thing. I’ve certainly never heard of anyone checking themselves into a hospital from the effects of a pineapple rum cake.
