Rudy Giuliani declares bankruptcy after being ordered to pay victims

He’s not likely to be able to discharge what he owes to his lawyers through bankruptcy, either. His lawyers probably have another remedy available, as well, which is to hold onto any original documents of his they might currently have, some of which could have value in their own right (and I don’t mean like blackmail stuff…I mean completely legal things…deeds, who knows). Similar to how an auto mechanic can be granted an automatic lien allowing them to legally keep your car until you pay them, attorneys can legally keep any documents of yours they have in their possession until you pay them.

(Disclaimer and bias: I’m actually going through a chapter 13 bankruptcy myself due to events from some bad decisions with doing two major remodeling projects on the house at once and maxing out ALL my financial resources and then some.)

Rudy’s filed for Chapter 11, which is a ‘debtor in possession’ reorganization type of bankruptcy. (Unlike chapter 7, which sells off the assets and the proceeds go to the creditors, and a chapter 13 is also reorganization, but the trustee or judge can require the debtor to sell off assets. 7 and 13 and generally used for personal bantruptcy, whereas 11 is usually used for businesses, which allows them to continue to operate and be able to borrow (with permission from the judge or trustee) additional funds.

It’ll delay the collection attempts, but as mentioned by others earlier, tort claims (like the defamation judgement) can not be discharged. The laywer fees are most likely also in that same class (secured creditor), so they are at or near the front of the line for creditors. IAMAY, so take that with a large grain of salt.

Frankly, he’s still perma-fucked, moreso because he’s continued to defame them after the judgement which has another lawsuit against him, which should be a slam dunk, unless rudy somehow manages to pull this ‘incontrovertible proof’ he keeps parroting out of his nether region. (which, if that’s true, why didn’t he already do that?!?)

EDIT: Also, the taxes that he owes the IRS are non-dischargable, so he’s double-fucked.

The plaintiffs have already moved to secure liens against his real estate holdings. The judge does not seem inclined to cut him any slack or allow him time to “reorganize” his funds out of reach.

:man_facepalming: I think if he were able, Thomas Paine would have had some choice and pungent words about that.

First, because the Constitution doesn’t give people rights, it grants the government the power to regulate the rights mentioned, and only those. The government has no direct power to forbid sleeping on the streets, and has to side-step from another granted power to get there.

Second, because Paine had a rough time in his final years, and might have spent some time on the NYC streets.

Unless I really fuck things up? It’ll only get better. I know the root cause of what got me into this, and even my attorney said “this really is the best way to get out of it in a timely manner.” I consider this a very expensive learning experience. :slight_smile:
