Wasn’t it Georgia or Alabama or somewhere that made it law that women who miscarry can be prosecuted if she did anything that a court might construe as “endangering the fetus”? I think the miscarriage had to be reported to law enforcement by either the woman or her doctor, too.
Although it seems to cap liability to one judgement per defendant, I see no limitations on the number of defendants.
The law also is very clear that it is not a valid defense that the defendant did not know the abortion would turn out to be illegal.
So basically anyone who knows they are assisting abortion and provides any help is on the hook for $10k.
So after notifying the state that you are going to get an abortion, any of the normal benefits that one receives from the state like roads, interest tax deductions, access to public transport, or even emergency room access create liability. Right?
I might protest by wearing a t shirt saying “I support abortion with whatever help I can get” and then suing whenever the state provides me with normal assistance.
Talk about victim shaming/blaming. It is acceptable in the eyes of Texas to compel a girl who is pregnant because of rape or incest to carry that pregnancy to term, if they didn’t know they were pregnant soon enough in addition to the aforementioned physical insults.
