  • Imbruvica, a drug for blood cancers

At least six pharmaceutical companies and two pharmaceutical trade groups have filed lawsuits in federal courts to try to block the negotiations, claiming that they are unconstitutional. But the Biden administration has said it will defend the negotiations vigorously.

Of course they are. What fucking constitutional grounds do they have for this argument, though? Given the extreme right wing position of the courts just now, I worry that this will fail at the USSC level.

And considering there’s almost no way the stock market isn’t experiencing some kind of bubble in some sectors (some aspects of pharma almost certainly would be)… there will be a downturn sometime. If it is bad enough yeah some places might suspend their div payments, and it will be proposed yet again, with the rational decorum of political pageantry and in the basest memes, that sick people’s lives are just kind of an inconvenience to everyone else anyway so screw 'em because if they want to enjoy what is left of their lives they’ll pay up and if they can’t hopefully they’ll die faster.

Taken together, the lawsuits make a variety of constitutional arguments. In addition to the assertion that the government is violating the Fifth Amendment by unjustly taking property, they include claims that the law violates the First Amendment by compelling drug companies to agree in writing that they are negotiating a “fair price.” Another argument is that the excise tax amounts to an excessive fine that is prohibited by the Eighth Amendment.

They’re just throwing argument at the wall and hoping one sticks. The law’s tax if you don’t negotiate and keep selling your product to Medicare is a bit odd, but they can always choose to not sell their product to Medicare anymore.
