Generally speaking, I agree, though the issue here seems to be keeping or removing the protections in their entirety, which would put rape, ptsd, etc back along with everything else as excludable pre-existing conditions. (Someone please tell me if I’m wrong about this)

Do you think that states will actually go through and specifically reclass just these things? (Not rhetorical, actually asking) Seems like that would be political suicide for state legislators, but then again, political suicide seems to be getting harder to pull off these days…

That very much depends on your definition of “backwards.”

And they do it retroactively. As in, “we discovered that you had dysmenorrhea at 15, so we won’t be covering your uterine cancer at 50 due to a history of reproductive health problems.” Enrolling at the usual “community” rate is, after all, fraudulent, as the mediation service will rule. Oh, yeah, your insurance policy has a mandatory mediation clause.

For the most part private insurance companies aren’t flat-out refusing to sell insurance to people with pre-existing conditions any more, they’re just charging exorbitant rates for doing so and thus putting insurance out of reach in practice if not in theory.

This case presents the question whether 42 U. S. C. §233(a), as added, 84 Stat. 1870, precludes an action under Bivens v. Six Unknown Fed. Narcotics Agents, 403 U. S. 388 (1971), against U. S. Public Health Service (PHS) personnel for constitutional violations arising out of their official duties. When federal employees are sued for damages for harms caused in the course of their employ- ment, the Federal Tort Claims Act (FTCA), 28 U. S. C. §§1346, 2671–2680, generally authorizes substitution of the United States as the defendant. Section 233(a) makes the FTCA remedy against the United States “exclusive of any other civil action or proceeding” for any personal injury caused by a PHS officer or employee performing a medical or related function “while acting within the scope of his office or employment.” Based on the plain language of §233(a), we conclude that PHS officers and employees are not personally subject to Bivens actions for harms arising out of such conduct.

In this case, a death panel cannot apply to glorious America Freedom Things like unregulated scam health insurance, only to socialist evil nonsense like Obamacare, whatever that is. In particular it is used when those evil Liberals attempt to meddle with your fine non-socialist private free market Medicare.

Oh good, that’s a 3rd preexisting condition on my list; my daughter was born via c-section. So to sum up: no birth control, no abortions, babies are precious … but you can’t have health care to have them, or for them, or to ensure you live to raise them. I know Lysistrata is a joke, but I swear to god we’re gonna have to just cut off men entirely. My husband says “this is how Children of Men really starts.”

This is also why I can’t watch Hulu’s Handmaid’s Tale right now. Too fucking close to home.
