He doesn’t caucus with Dems since leaving – press have seen him sitting alone outside the Capitol prior to session when the parties are caucusing. Definitely still votes like 95% Dem.

Holding hostage to repeal gay panic defense if he doesn’t vote their way. His seat got moved right into the middle of GOP leadership after he switched to I. Bet they’re watching that voting station like hawks.

Re switching party for the gay panic defense vote: The Senate Judiciary Committee voted to kill the bill just a week prior directly on party lines, same way it did every year. Then, not long after, EVERY GOP senator suddenly voted for it, even those who had never voted for a pro-LGBTQ bill before or since. Something unusual intervened.

(Went to law school with him and still work in Concord, hence some knowledge.)

There’s a reconsideration vote on the bathroom-sports-prisons bill, probably on the 25th. Good chance to remind everyone to actually show up and for those who voted against last time of just what’s at stake.

Yeah I just can’t see every Republican switching votes because one Democrat leaves the party. Why? What do they get out of that? It doesn’t make any sense.

They get to humiliate the Democrats and humiliate him. “Democrats in disarray” is always a favorite headline. And, it worked – the story is still discussed six months later.

I do know that there had been a lot of talk of him being a rising star in Concord. He had impressed a lot of people, especially with his work on Commerce Committee. At that point, there was rumblings of him running for Exec Council from that district because Warmington was obviously going for governor.

Switching him to an I killed Shaun’s political career. I saw him at Revelstoke after he switched and he said he knew that he’d killed any chances of running ever again, but “he had no choice.” I didn’t know what he meant until I heard this rumor. It’s kinda weird to sorta be on the inside but not really.

Anyhow … we just gotta hope for a better vote on the 25th for reconsideration. All their legislative emails are public. Or if you’re near Concord show up before session on the day for the rally. Gotta hope for the best.

That still doesn’t make any sense. Unless he’s a complete moron, in which case…good riddance? And it still doesn’t explain why he voted for this anti-trans legislation. I’m a big proponent of Occam’s Razor, and him being an idiot and transphobic is a much simpler explanation for this whole story.

It’s even worse if you read the whole definition of “obscene matter”:

(n) “Obscene matter” means matter that:

(1) An average person, applying contemporary adult community standards, would find, taken as a whole, appeals to the prurient interest, is intended to appeal to the prurient interest, or is pandered to a prurient interest;

(2) An average person, applying community standards, would find depicts or describes, in a patently offensive way, sexually explicit conduct; and

(3) A reasonable person would find, taken as a whole, lacks serious literary, artistic, political, or scientific value.

(4) For the purposes of any prohibition, protection, or requirement under any and all articles and sections of the Code of West Virginia protecting children from exposure to indecent displays of a sexually explicit nature, such prohibited displays shall include, but not be limited to, any transvestite and/or transgender exposure, performances or display to any minor.

So, parts 1, 2, and 3 are the standard obscenity test in US law. Basically, the “I can’t define it, but I know it when I see it” test. It’s a reasonable person test. Whatever a reasonable person would find obscene is obscene. But then, just in case a reasonable person doesn’t think trans people or drag queens are obscene, they add item 4 to make it clear that any exposure of trans people to children is, by definition, obscene. It’s ridiculous, and clearly unconstitutional. The whole thing is also so poorly written that it’s practically illegible. Like this part:

Any school officials or school personnel while engaged in a professional capacity or activity any public-school library, classroom, building or other facility under the general supervision of the state board shall be deemed a custodian of children under §61-8D-4 of this code.

I’m guessing there’s supposed to be an “at” or an “in” in between “activity” and “any”, but the whole thing reads like that.

Yeah, WV has become MAGAt nirvana. There is precious little effort to push back on this kind of shit precisely because young people, educated people and most folks who are able have left, leaving a frightened, old, white. poorly educated population who have been told that “the libruls” are coming for their lifestyle and their children. As one who (was) young, educated and able, I also fled the state as soon as I could. I have to say, sad as it makes me, barring something truly earthshaking, I see no way they will come back from that abyss. As the olds die off, there is precious little to replace them. The state is on a death spiral right now.

This is not a case of someone dog-whistling or “saying the quiet part out loud”. This is someone openly and proudly calling for the executions of trans people.

Someone should repeat that entire Bible verse to her, because she’s pulling it out of context.

Jesus said to his disciples: “Things that cause people to stumble are bound to come, but woe to anyone through whom they come. It would be better for them to be thrown into the sea with a millstone tied around their neck than to cause one of these little ones to stumble. So watch yourselves.

“If your brother or sister sins against you, rebuke them; and if they repent, forgive them. Even if they sin against you seven times in a day and seven times come back to you saying ‘I repent,’ you must forgive them.”

That first section is a warning to the apostles. That second part doesn’t say a damn thing about executing anybody, even if they don’t repent.

Marshall responded to the appeals court’s Thursday decision, writing, “The physical and psychological safety of our children can now be better protected from these untested and life-altering chemical and surgical procedures.”

Oh fuck off. Surgeries are exceedingly rare, and the medications are very well tested, and even given to cis kids for various reasons, which the law acknowledges by exempting those treatments. I’m not surprised by the decision. It’s just the full 11th Circuit affirming a decision a 3 judge panel of the 11th Circuit made last year. Still sucks.
