Conservatives: “We can’t know why they entered the capitol, but I think we can all agree that Democrats are very mean for blaming Trump. He wasn’t even there! Also, it wasn’t as bad as antifa made it look on live television.”
This is a very interesting lawsuit which seems destined for SCOTUS. I can’t see it succeeding there given how conservative the court currently is, though. It’s a very difficult thing to prove, as well, even though it is technically settled law that incitement of violence is not protected speech. Any more knowledgeable Boingers know of cases where the “can’t shout fire” condition has actually defeated a 1A defense in a case?
