Do we know why she wasn’t charged with domestic terrorism based on her own confession? Did the prosecutor think that would have hurt their chances of convicting her on the lesser charge?

The FACE Act was signed into law in 1994 by Bill Clinton. Biden was a Senator at the time, so I assume he voted for it (I just checked…he did). Harris was a deputy DA in Alameda County, CA at the time, so blaming her seems odd.

There’s no such crime with which to charge anyone. US Code defines domestic terrorism, but provides no specific penalties for engaging in it.

The US has problems that other, similar countries don’t have, though. And usually, when you drill down into the historic causes of those problems, the answer is, with surprising regularity, racism. Which obviously also isn’t unique to the US, but the US has had a particular strain of racism that’s existed since it was founded (and was, in some ways, intertwined with its founding) that wasn’t the case with most other countries.
