The problem I have with this theory is that if plaintiff’s attorneys can determine that Jones’ counsel had his cell phone during discovery and didn’t disclose the requested information, I’m almost positive that’s sanctionable conduct.

The plaintiffs were under a duty to wait for defendants to declare the info privileged.

It looks like Jones’s own lawyers burned him. They probably did not want to be brought up on professional ethic charged for willfully violating discovery orders.
