This is Brexit. I don’t think the European Court would have upheld this.
This would be appealable to the European Court of Human Rights (ECHR) not the ECJ which is the court of justice of the European Communities so it’s not affected by Brexit. That said they have been moving away from the Council of Europe (membership of which is a precondition of membership of the EU and is the main court of super national human rights law in Europe) for some time now. International agreements interfere with an English sovereign’s divine right to do what he damn well pleases.
It’s confusing, and if it’s boring and largely non-controversial, it’s working as planned. The European Acronymns thing that is.
What do you mean by “the dumbest timeline”?
As the CoE is the established church of his majesty, might there not be some constitutional issue with bishops preaching against his maj’s government’s policies? I guess the bishops would have a human rights argument to counter that but it may well not be as mad as it sounds at first glance.
Isn’t there established precedence for dealing with those cases?
