This is fairly much over my head, but it sounds like he could try & move his case to Federal Court, but then he’d potentially be facing Hatch Act charges (in addition to, or instead of(?) the existing charges). But maybe he’d still rather face that, instead of state charges (& prison, & pardon procedures etc.)

The Hatch Act is significant not because of the threat of actual legal exposure, but by the fact that it makes electioneering clearly and automatically outside the scope of Meadows’ and TFG’s “official duties.” (an essential element to get the case removed) The court needs to read both the Hatch Act and the removal statute harmoniously, and will only remove so as not to do violence to the Hatch Act. The statutory interpretation by the judge is completely separate from a DOJ charging decision, and is basically an exercise in hypotheticals. “Would calling up a state official to change votes to get my boss elected violate the Hatch Act?” If the answer is “Yes,” then no removal for you, Mark.
Another big problem for Meadows is that the Constitution puts Congress and the States in charge of elections, and does not provide a role for the Executive Branch. So his claims that he was just trying to enforce election integrity is bullshit legally as well as factually. The amicus brief by Judge Luttig and others, linked in the article, goes into the lack of Executive duties regarding elections. The judge at the hearing keyed in on this point by asking Meadows "“Is there a role under Article II of the Constitution for the president in a state election or any election?” Meadows punted, which did not help his case.
It is encouraging to see a handful of Republican attorneys and judges caring about the rule of law and weighing in on this.
