Total idiot!

Since he was able to open the door of the place despite them not being open I strongly suspect he had keys to make deliveries. He misused that access, of course his employer is unhappy!

Make the video, send it to the health department. Don’t post it!!

After exposing the kitchen situation; the restaurant lost all its customers and all staff is out of work.
Simple and easy.

Intent matters here, right? If his first move would have been to report the violations I would be all in his corner, but I didn’t get the impression he was attempting to correct anything. This seemed to have started with just a lark. Hey, check out these crazy rats at this one place.

he was right and he was wrong, as @anon12509749 posted above. if he took that video to the city board of health, he is a whistleblower and a stand up guy. putting the video on social media for the shock value is not quite the same thing. a reprimand though, instead of suspension would have been appropriate.

So, it’s complicated, but he’ll probably win a whistleblower retaliation suit and wrongful termination suit.

This individual acted as a whistleblower against Popeye’s which was not his employer. He had the keys to the building, meaning he wasn’t trespassing. However, his employer is a supplier to Popeye’s, and probably feared retaliation from them, which would have been illegal, and therefore fired the whistleblower for whistleblowing on their customer, which is retaliation and illegal (and a conflict of interest).

That he posted the health code violations on social media wasn’t the best way to report, but most whistleblower laws specifically don’t address how, or why, the whistle was blown. Hate your (ex)employer and want to tell the world about how they are breaking the law in order to punish them for treating you like dirt? Congratulations! You’re protected!

The key is reporting a crime, or what you in good faith think is a crime (as opposed to making something up).

Whoever made the decision to fire this guy really should have spoken with a lawyer first.

He put the health & safety of the general public above all else, not to mention the employees that endured working exposed to rat feces, the diseases they carry, and the stress of working in that filthy place. You can ride the fence my BB friends, but he is my hero of the day.

BTW: For clarity, I worked in the SD Health Dept. for 15 years [retired], Chef for 50 years[retired]. However, when ever the information got to us like this, we are were thankful, and followed up immediately. Now picture this is taking place in our Nations’ Capitol? That kitchen had the look of post apocalyptical hell, let alone a place that serves food to humans.
