Almost four years later, the Minnesota Supreme Court unanimously ruled this week that Francios Momolu Khalil, 24, cannot be found guilty of rape because the woman got drunk voluntarily beforehand. absolutely preposterous decision. i donāt care when she drank or how much she had to drink, if she was unconscious she could not possibly have consented. this is the worst timeline.
I wonder if theyāll apply this to medicine. Like once a patient has been put under anesthesia they now can be operated on at the pleasure of surgeon and any medical students without consent since they agreed to be put under in the first place.

Was wondering the same thing about other crimes, like theft. Does every charge become some low-level misdemeanor if the victim voluntarily gets drunk? Asking for friends in the Midwest whoād love to buy some judges and legislators a few rounds of drinksā¦

So I understand this, in Minnesota, if a woman has had a few drinks, sheās fair game for sexual assault? And women justices thought this was ok? What in all the hells is going on up there?
to my mind itās objectively worse than the way you stated it. the way i read it, instead of saying that she couldnāt give consent because she was unconscious they ruled that because she was unconscious she couldnāt withhold consent, which really turns things upside down.
It really is difficult not to think that surely something is missing here.
So itās okay to rape someone because they happen to have rendered themselves basically comatose? Really??
I think it might be because the state distinguishes between violent/forceful rape and so-called date-rape (which is a gross distinction to make, but not all that uncommon unfortunately) and the ruling means that the perpetrator can/will be charged with a lesser offense. The WaPo article says that heāll be charged with fifth-degree misdemeanor sexual assault (blech) and that the voluntary intoxication loophole is the (old, poorly written) law in many states.
Remember, itās not really rape if at any point in the evening she was enjoying herself! She got herself drunk, so itās her own fault for being able to be raped. How is a guy to know that she doesnāt want sex, now that she is drunk?

Damn, that is a take I had just refused to accept. āConsent is assumed, and must be actively denied to be taken as no. In her state she was unable to withdraw consent, therefore there was no rape.ā OMFG
Somehow I feel worse that she lied instead of simply saying yes. No need for details beyond Iāll explain more when youāre older.
More effective if you can tie it to current behavior that includes them: āthereās a reason I never leave you alone with my parentsā or āthatās why I act weird when Iām scaredā or āthatās why Iām so committed to helping you learn how to be a good human beingā. So they know there are long term consequences but also itās possible to make things better.
