So what is Barr’s job? Protecting the president? Protecting the people of the US from an ill-tempered, self-obsessed, crooked president does not seem to be high on his list.
His job is very much to be fully independent from the executive branch. He is meant to be the attorney general for the people of the US, not for the president. The president has his own official legal consul, plus he can hire private attorneys. The justice department should uphold the rule of law, not protect the president.
Independence is an ethical norm; it’s not a legal requirement. In other states, the attorney general is a separate elected office, for instance.
Trump’s tweet should make the AG’s job so much easier were there one there to do the job for the people rather than for the executive.
Doesn’t make it any less true. Not having an independent DoJ is a dangerous precedence that opens us up to a much more authoritarian state.
After Trump is defeated, perhaps, the lessons learnt can be written down with more permanence.
New York is one of those states where the AG is a separately elected office. Which makes it kind of interesting that Trump’s tweet calls on Cuomo to stop the prosecutions. (He doesn’t understand that a governor is not a dictator, any more than a president is. It goes without saying that Trump has also no understanding that a president is not a dictator.)
