Alan Dershowitz envisions Trump as the first President serving from prison

Aside from the fact that this is not what is actually in the laws about this, I’m reasonably sure it strongly depends on which side of a civil war you fought.

Eugene Debs got more than a million votes running for President while in prison. Unlike TFG, Debs was imprisoned for sedition. His sedition was publicly advocating against the draft and urging soldiers to not fight in WWI, while TFG’s sedition was in trying to overthrow lawful elections.

Just goes to show how “justice” is meted out.

Correct on both points.

Section 3 prohibits public office holders who have taken an oath to support the U.S. Constitution and then engage in insurrection or rebellion against the United States, or who give aid or comfort to enemies of the United States, from serving in public office.

And Dersh knows it, but he’s already preparing his client’s defense.
