Time-travel the tape back to Oct 2016? Avoiding a first Trump presidency would be amazing. I don’t know that there would be a significant number of voters swayed by this recording who weren’t already swayed by the Access Hollywood tape, though.

What I’ve always heard was that for cases like this that involve the public interest (as opposed to giving corporate secrets to competitors or whatever) the whole point of the NDA is to sound scary and intimidating, especially for low-level employees, rather than being an ironclad legal document that’s likely to be upheld in court. Any lawyer can put together a legal-sounding threatening document. But more often than not the company won’t actually even try to go after folks who violate it. And assholes like Pruitt had more than enough opportunities to do some research, get some legal counsel, and push back against the NDAs like Stormy did way back in 2018.

So basically like all those signs here saying “management is not responsible for….” Etc. because they are just words that have no weight whatsoever. They might cow the unwary, but they don’t mean a thing.

Jail time? From an NDA? No. No NDA can do that. There is no law that allows for criminal prosecution for violating an NDA, which is just a contract. If you violate an NDA, that’s breach of contract. The worst that could happen to you is that you have to pay the other party a shitload of money and maybe an injunction against revealing anything else. Contracts are a civil matter. You can’t be sentenced to jail in a civil matter. Either that NDA has some ridiculous bullshit in it that a first year law student would laugh at, or this guy doesn’t know what he’s talking about.
