I think you could make that argument, but DMCA has long been used as a tool to silence speech. So it’s not surprise. It’s not explicitly in the public domain, though, so it’s subject to copyright restrictions.

However FedEx got the copyrights, they apparently have standing to have a DMCA issued. I wouldn’t be surprised if there was a late night call involved.
