I hate that the “corporations are people” principle completely protects him from consequences. Justice would be sending him out, without his 150 bodyguards, into the desert with a truck and a shovel, and letting him leave when it’s restored to how it was pre-dump.

Looks like they didn’t just dump materials on the land, but tore down trees and dug up grass. They should take all the materials and sell it for scrap and take all those construction vehicles and sell those too.

Proud original participant here. Can’t wait to see how they attempt to twist the law to justify encroachment onto private property, in Texas of all places. Sadly, elon’s unlimited budget makes victory unlikely, but this should be open and shut…

If you can develop land better than someone else you have a right to take it from them. That was Ayn Rand’s justification for dispossessing the Native Americans, anyway, without which there wouldn’t be any of this property to trade in the first place.

This seems like the sort of case where you can either find in favor of the plaintiff or you can admit that ‘private property’ is a lie we tell to make oligarchy sound nicer.

My uncomfortable suspicion is that the fine local justicemancers will square that particular circle by ruling against Musk; but deciding that the actual damages are about a buck fifty because reasons.

That is the justification for all colonialism, taking land from “primitive” peoples and giving it to a “civilised” people who will develop (exploit) it more thoroughly.

They get pretty twitchy about stuff like the National Park System too, feeling that they should be run like for-profit amusement parks.

Their accounting doesn’t assign any costs for the loss if the parks were clear-cut and bulldozed.

It appears that this is one of a whole series of plots and SpaceX owns most of them including the ones either side so it’s vaguely possible that this was a contractor mistake and they didn’t realise this wasn’t for them to use.
But that is no excuse, they should have been well aware of this, and need to make good the property (if that is even possible after the damage they have caused).

And responding to a mistake like that with a time-limited offer to buy the land for cheap confirms they don’t care anyway. For the record, the linked Reuters investigation shows how routine it is for this company not to care about other people’s property.

Externality n. (Economics) something which exists only insofar as it doesn’t meaningfully exist. It can be used up or destroyed at no cost to you, which is the same as saying “at no cost”, economically speaking.

Wait, so if a group of us got together and frog marched Leon right out the door of whatever business he was stinking up at the time, we could just take it over with no questions asked? (Because I can pretty much guarantee anything he’s managed to get his grubby little fingers on could be better handled by someone else.)

I didn’t want to own Tesla, but I think my cats would do a better job of running it. They’re quite good at just lounging around and letting others do the business of actually running things instead of insisting they make the decisions!
